His trial was scheduled for cd’s mtv November 1994. But the cd’s mtv case was postponed, and it lingered for four years, before being scheduled for trial again. At a hearing in mid-May 1998, Franklin Circuit Judge William Graham admonished Burton to get the case tried. Burton promised cd’s mtv to do that quickly. So after a four-year delay, the case was again set for trial — first for that June, and then November. But a jury never heard it. It sat again for four more years, with no action until it was dismissed at Cleveland's request in January of this year. Bowen could not be reached for comment. His attorney, Bradley Smith, said he did not remember the case. In an interview, Burton, the former prosecutor, said he didn't recall that Bowen had told police he had had oral sex with the girl. Burton said the family wanted the case to go forward but he didn't pursue it because the girl was hesitant to testify. "(She) would almost cry when you talked to her about it," he said. "So I elected to go with her wishes and not her family, with the urging of the police officer."
