Without a prosecution case they never come to court as it is a waste of money. Here there was no prosecution case, but the police and state lawyers felt as a crime might have been committed it should go to court. The judges can only apply the law they are given to work with on the facts provided. I bet many of you guys (at least in Sweden) have leered at good looking girls who in fact were only 13 but looked 16 / 17!
